Before transferring funds, the buyer should obtain written instructions from the lawyer and notary. Payment references, account holders, beneficiaries, instalments and completion balances should remain identifiable. Bank receipts and account statements should be retained in a transaction folder.
If the payment structure changes, the notary should confirm whether the deed or certificate needs to reflect that change. Informal substitutions, unidentified third-party payments or inconsistent descriptions can make the file harder to reconcile.
Conditions and full payment
A purchase deed may contain conditions concerning payment, delivery, releases or other transaction steps. The official certificate requirement specifically refers to the lifting of any resolutory condition and the deed of full payment.
The legal team should explain whether the proposed deed transfers full ownership immediately, whether any condition remains outstanding and what evidence will close it. The buyer should not assume that possession of keys or completion of construction has the same legal effect as satisfaction of the deed’s conditions.
Why previous Golden Visa use is checked
The notarial certificate must address whether the seller has used the specific property for a Golden Visa. This point helps the authority understand the property’s immigration history. It also reinforces the need to identify the exact legal unit, not only the development name or internal apartment label.
The buyer’s lawyer and notary should confirm the required declaration and any supporting review. A developer’s general statement about the building should not replace the property-specific certification requested by the official procedure.
Proof of registration after signing
After the deed is signed, the registrable act must be submitted to the competent land registry or cadastral office. The official procedure lists proof of registration, registration of the registrable act or a lawyer’s certificate under the applicable Lawyers’ Code as evidence for the file.
The registered property description should be compared with the purchase deed, cadastral details and technical documents. Names, deed numbers, unit descriptions and ownership rights should be consistent. Any correction should be handled through the professionals responsible for the relevant record.
When proof of an application for registration may be used
The official procedure provides a limited alternative for initial issuance: proof that an application for registration or entry of the registrable act has been submitted, or the corresponding lawyer’s certificate. This can address the interval between filing the deed and completion of registration.
However, the same official guidance states that final proof of transfer or registration with the cadastral office must be submitted with the Golden Visa renewal application. A temporary filing receipt should therefore remain on a follow-up list until the definitive evidence is obtained and stored.
How the engineer’s report connects to the transaction
The EUR 250,000 change-of-use route also requires an engineer’s technical report. The engineer confirms that the main spaces changed from the former use to residential use and identifies the relevant permit, file update, small-scale works approval or permit revision.
The official wording connects the converted property, investor and notarial deed. The engineer’s report should therefore refer to the same property acquired in full ownership and possession under the deed. A mismatch between the technical unit and the registered legal unit should be resolved before submission.
A document reconciliation table
Before the residence application is filed, the buyer’s advisers can compare the core documents in a simple reconciliation table. Useful fields include:

- Seller and contracting-party information.
